Dentists Sharing a Practice Ordered to Mediation to Resolve Differences

Two dentist who operate their practices out of the same premises have been ordered to attempt mediation by the judge overseeing their case.

 

The dentists, Drs.  Michael Maguire and James Hiney co-own a building and operate separate practices from that building.  For years, they happily shared the space, but recently the environment has been described as “toxic. ”

 

According to Dr.  Maguire, his staff were surveilled by a secret camera allegedly put in place by Dr.  Hiney.  Hiney admits to installing the camera in a hole in the ceiling, but claims it was put in place for security reasons and not with the intention of spying on Dr. Maguire or his staff.

 

Claiming he does not believe Hiney’s explanation for the camera, Maguire also seeks various injunctions against Hiney, including one that would stop the use of the surveillance camera.  Additionally, Maguire has asked that all data, including patient lists, be returned to him as part of his damages.  He also requested his patient not be solicited via email, text, or any other means, and that all construction work occurring on the premises be halted.  According to Dr. Hiney, there was never any intention to carry out construction work as long as Dr. Maguire was operating a practice out of the building. 

 

Dr. Maguire was granted permission to serve short notice injunction proceedings against Dr. Hiney by the judge.  However, the judge told the parties that the court would be unable to hear further arguments and they would need to work to resolve their differences via mediation.
