WHAT IS MEDIATION?

Mediation is a common sense means of alternative dispute resolution (ADR) which allows opponents, with an impartial mediator’s help, to arrive at solutions with which each party agrees upon.  Mediation involves a wide range of alternatives such as facilitation, group problem solving and consensus building.  In many court proceedings, mediation is required before the case can go to trial. Mediators facilitate communications, encourage and explore the issues and alternatives, and advice of possible adverse consequences and positive results to the controversy.  Unlike a judge or arbitrator, mediators make no decision.  Mediation results in solutions from self determination instead of a third party decision.
