Circuit Civil Cases

We have found that the majority of our mediations are completed within a two hour time frame.  We typically schedule a morning and an afternoon mediation which allows for additional time to complete the mediation where necessary.  Upon request we are amenable to schedule shorter mediations, or booking an all-day mediation.

 

Family Cases

Family mediations are scheduled morning, afternoon and evening hours. Additionally, weekend hours are available with no additional charge.

What is Mediation?

 Mediation is the best alternative to litigation.   Mediation is a confidential, effective, inexpensive, informal way to resolve a dispute quickly.  It is the intervention into a dispute or negotiation of an   acceptable, impartial and neutral third party who has no decision-making authority.  The objective of this intervention is to assist the parties in voluntarily reaching an acceptable resolution of the issues in dispute.

Mediation is useful in highly-polarized disputes where the parties have either been unable to initiate a productive dialogue, or where the parties have been talking and have reached a seemingly insurmountable impasse.  Mediation is an intelligent means to a just solution.  It is controlled entirely by the parties.  The parties always retain their right to litigate if an agreement is not reached, and even if an agreement is not reached, mediation usually narrows the scope of what will be litigated.  It can reduce the cost and length of litigation.

Why Mediate?

People generally consider using mediation to deal with a dispute to avoid a lawsuit or terminate legal proceedings because compared to a lawsuit, mediation is a faster, more confidential, and a less expensive way to deal with conflict.

Mediation is appropriate when parties have given up on negotiating a settlement directly with one another, or their counsel have attempted to negotiate the matter and have reached a deadlock; and the parties hope to resolve the matter in a process that is less painful and more efficient than litigation.

A mediation conference can usually be scheduled within a few weeks.  Many mediation conferences, depending on the matters at issue, can take less than a day to resolve.  Other benefits can include:

-          The parties maintain privacy and control over the outcome of the dispute

-          It is informal and inexpensive -- attorneys may but are not required to participate

-          It is a quick, non-adversarial approach to conflict resolution

-          Mediation addresses all the issues, and identifies the underlying problems

-          It encourages creative solutions to the parties needs

-          Mediation can preserve and enhance the parties current relationships, while setting guidelines for future relationships

-          Mediation eliminates festering and magnification of disputes which accompany costly litigation
