Tom Nielsen has 40 years of experience as a trial lawyer and litigator and over 20 years’ service as a mediator, arbitrator, and settlement judge pro tem.  Tom has extensive experience in areas that include personal injury, professional errors & omissions, products liability, real estate, business and contracts, construction, insurance, including bad faith, property damage, automobile/trucking accidents, UM/UIM matters, governmental entity, employment, and complex and catastrophic injury cases. 

As his legal career progressed his desire to become a problem solver and peacekeeper became stronger.  Over the last half of his career, Mr. Nielsen was drawn to the area of mediation, because it resonated with his core values of creating peace, rather than conflict, and can serve to promote understanding, while also preserving individual values.

Tom has completed extensive mediation training and was named to the 2013 Northern California Super Lawyers list in mediation.

The legal system is overburdened and unfortunately the current state of the judicial system does not have the financial resources to effectively resolve all disputes. Traditional lawsuits are time consuming, expensive, and often do not meet the needs of the parties because there it rarely supports a “win–win” proposition.

In contrast to the tradition lawsuit, mediation promotes dispute resolution through a voluntary process that is confidential and strives to promote cooperation, collaboration, and understanding, rather than cohesion. The mediator is an impartial “neutral” participant (never an advocate) who facilitates the mediation process with the goal of creating an environment supportive of mutual cooperation and understanding of each other’s points of view, while parties work toward the common goal of resolution while reaching their own mutually beneficial solutions.

A successful mediation can reduce the high costs of litigation and provide parties with a sense of completion and closure, while preserving their own values.

WHAT IS MEDIATION

Mediation is conducted by an experienced neutral, impartial mediator who works with all parties to facilitate the mediation process with the goal of fostering an atmosphere of mutual cooperation and understanding of each other’s points of view, while they work toward the common goal of resolution of their dispute. Mr. Nielsen is this type of mediator.

Mr. Nielsen works through a confidential process in an attempt to resolve the conflict. He allows the parties involved in legal disputes, through a process that promotes mutual understanding and cooperation, to achieve their own resolution and make their own decisions while preserving their interests and values.
