Could the UAE Benefit From Mediation?

Although alternative dispute resolution is becoming more popular across the country and around the world, mediation is still not used as much as it could be.  Certain cultures may find incredible benefits offered through mediation.  For example, in cultures where contracts are not always seen as hard and fast terms but rather as a framework to guide relationships, mediation can help to resolve disputes over these contracts in a friendly and professional manner.  Individuals who are willing to compromise and negotiate with one another will find that mediation provides them exactly the forum to do that.

Mediation is not necessarily about winning or losing.  Instead, the focus of mediation is to reach a compromise.  Establishing constructive dialogue between two disputing parties can be beneficial for numerous cultures and individuals living in countries all over the world.  The process is assisted greatly by the implementation of a neutral and trained mediator.  The situation tends to be resolved much more quickly when that mediator is trained in the area of dispute over which the two parties are arguing.

Citizens in the United Arab Emirates (UAE) might see that one of the best aspects of mediation is that parties are empowered to achieve more creative outcomes than those that would otherwise be imposed by a court judge or a tribunal.  Since it’s a less formal process, participants are encouraged to interact with one another and generate their own solutions.  When used in the preliminary stages of the dispute, mediation may help those parties to reach a resolution before the legal aspect of it escalates into court.  This helps to reduce the overall cost and stress associated with the issue as well.  Finally, mediation can help to repair existing relationships and set ground rules for interacting in the future
