Long Island Divorce Mediation After Changes in State Law

Long Island divorce mediation: some analysts are predicting an upsurge in divorce filings due to New York State’s recent change in their marriage laws.  Previously, New York had remained one of the few states in the country where lawmakers had yet to adopt a no-fault divorce system.  New York remained mired in a past where divorce was possible only on specific grounds; "inevitable breakdown of the marriage" was not one of them.

 

Six months ago, all that changed.  New York updated its divorce statutes to allow for an "inevitable breakdown" filing.  So far, statistics do not indicate a huge rise in divorces, but the change may take time to have its full effect seen.  If divorces do begin to skyrocket, Long Islanders will be glad to know that New York does allow divorcing couples to use mediation to reach an amicable settlement.

The process of divorce mediation takes place away from the stress and possible bright lights of a courtroom.  Instead of a judge hearing both sides and issuing a decision, the husband and wife sit down together in private, and with the help of one or more mediation attorneys, learn to work out their differences on their own.  The process is both faster and less expensive than the traditional route.
