Mediation          

Beginning in 1994, I have mediated more than 600 matters in litigation or headed to litigation.  In more than 90% of those matters, the mediation successfully resolved the ongoing dispute.  As part of my mediation strategy, I strive to meet and know clients and counsel and to actively learn the respective stories and investigate the material issues.  At each mediation, I work hard to learn the case, the substantive issues, the evidence, the strengths and weaknesses of each side's story and to engage with the competing narratives: affirming, challenging, pushing, and reframing.  I believe that by deepening the understanding through facilitated conversation between the parties I can frame solutions that are creative, flexible and acceptable.
