Mr. Henn has sat as an Arbitrator for over 25 years, and has has nearly 40 years of experience in commercial and business litigation as an associate and then partner at Foley Hoag LLP, substantially focusing on securities, banking and finance related disputes in the federal courts. Mr. Henn currently acts as an arbitrator for the Institute for Conflict Prevention and Resolution (“CPR”), the American Arbitration Association (“AAA”), Commercial Panel, the AAA Large, Complex Case Panel, the AAA International Centre for Dispute Resolution, and the Financial Industry Regulatory Authority.

Mr. Henn is a graduate of Harvard College (magna cum laude) and Harvard Law School (cum laude), was a law clerk for the Massachusetts Supreme Judicial Court, and was a long-time editor of the Massachusetts Law Review. He has frequently lectured in continuing legal education programs

Experience


Arbitration in numerous national and international disputes since 1984 on panels or tribunals for: American Arbitration Association (commercial cases, including Large, Complex Case Panel); Institute for Conflict Prevention and Resolution (CPR); International Centre for Dispute Resolution (ICDR) and FINRA. Has acted as sole arbitrator, panel chair (usually serves as chair of any panel), or panel side arbitrator, in disputes involving:

Financial Services, Investments and Fiduciary Duty

Financial services, investments and banking, fiduciary duties, close corporation disputes, purchase price earn out disputes, major stockholder or partner buyout disputes, and bank budgeting and profitability consultancy disputes.

Commercial Contracts and Intra-Partnership Disputes

Various contracts for substantial goods and services, manufacturing and computer performance disputes; technology sale and technology performance disputes; nuclear power plant staffing cost disputes.

Intellectual Property

Intellectual property use and performance disputes and related matters, including licensing disputes for patent and/or IP.

Energy

Energy sales, delivery, transportation and performance, including coal, gas, LNG and hydro, and ship construction disputes involving coal and LNG carriers.

Franchise

Automotive industry; food services industries.

Professional Partnerships Including Law Firms

Various disputes, including partner(s) separation disputes involving various professional firms, and also venture capital firms.

Other

Transport contracting disputes; real estate development entity disputes; professional sports and entertainment event promotion disputes; laboratory information systems disputes; and a variety of contract matters.

Familiar with all AAA commercial rules (including LCC) and ICDR rules, as well as CPR rules, and various international rules (e.g., UNCITRAL). Lectured in 2013 on both the new AAA Commercial Rules, and the new CPR Administration Rules.
