Mediation is a process for settling disputes without the involvement of a court or a judge.  It involves a trained third party who works with both sides of the dispute in an informal discussion, to help resolve the dispute. The mediation process is also non-binding; neither party is required to accept the mediator's proposed agreement. The parties to a mediation may or may not have an attorney present.  The mediator cannot decide the dispute but rather acts to facilitate the discussion and the negotiation process.  A skilled mediator can often help the parties to reach a mutually agreeable settlement when the parties have been unable to do so by themselves
